Yobe APC Primaries: Justice Murtala Adjourns Gov Case To Sept 2026

The Federal High Court Sitting in Damaturu, the Yobe State capital, has adjourned the case between APC Governorship Aspirant, Mustapha Maihajja, and the All-Progressives Congress (APC) to the 7th, 8th and 9th of September, 2026.

The Presiding Judge, Justice Fatima Murtala-Amin, highlighted the role of the judiciary in promoting fair hearing and the establishment of justice.

The aspirant, Maihajja, had petitioned the All-Progressives Congress (APC) for irregularities in respect of the conduct of Governorship primary elections held on May 21, 2026, saying due process was not followed.

Mustapha Ibrahim SAN, the counsel to the Plaintiff, revealed that nine witnesses have been presented to the court.

“We started the case yesterday, where 4 witnesses were presented, and today 5 witnesses, making a total of 9 witnesses have so far been presented. The summary of our case was that what took place on the 21st of May, 2026 during the governorship primary elections was not in accordance with the guidelines and procedure of the party, so the witnesses that came testified to their eyewitness account: there was no election, there was inflation of votes,” he said.

In his response, Baba Dala (SAN), the Counsel to the defendant, said the case still has a long way to go, as only 9 out of the 62 witnesses appeared in the court.

“The case is over an allegation by the Plaintiff over the conduct of the governorship primary election. They only presented 9 out of the 62 witnesses that have been taken; within a period of 3 days, we still have a long way to go”

“They asked for adjournment, and we have adjourned to another session of 7th, 8th and 9th September, 2026 to conclude on the remaining witnesses they have; they said they have 62 and only 9 witnesses were brought; that is to tell you where we are going,” he said.

There were about 5 aspirants, including former Inspector General of Police, Senator Mohammed Bomoi, A legal Practitioner, Kashim Musa Tumsah, among others, who criticized the primary elections but later withdrew.
