In the year since the Jan. 6 attack at the U.S. Capitol, those affected by the riot have filed several federal lawsuits against former President Donald Trump and others they blame for the violence.
The lawsuits largely rely on the Ku Klux Klan Act of 1871, a post-Civil War law aimed to protect Black Americans from white supremacists. The same federal statute—albeit a separate section of the law—was used in the recent trial against the white nationalist organizers of the deadly rally in Charlottesville, Virginia, in August 2017. The jury deadlocked on the two claims brought under that act, and the plaintiffs are now weighing whether to retry them.
