Nigerian Sues Malaysia Govt N406m for Unlawful Detention

Simon Mamoh of Nigeria has filed an N406 million lawsuit against Khairul Dzaimee Daud, Director-General of the Malaysian Immigration Department, and three other individuals for what he claims to be illegal detention and deportation.

Mamoh claims that the immigration division of the nation held him against his will for 40 days before deciding to send him back to Nigeria from Malaysia.

Mamoh specified the forms of compensation he is requesting in the civil complaint he filed on January 10 in the High Court of Shah Alam, including RM2 million in general damages at a rate of RM50,000 for each day of his unlawful incarceration, from March 15, 2021, until his release on April 23, 2021.

He is also seeking exemplary damages of N406 million, special damages of N3,925.31, and RM1 million in damages for pain, suffering, emotional distress, and mental agony, according to a local Malaysian online publication called Malaymail (current exchange rate).

The Director-general of the Immigration Department, the director-general of the Malaysian Prison Department, the home minister, and the Malaysian government were named as the four respondents in the lawsuit.

The lawsuit is scheduled for case management at the High Court in Shah Alam on February 9.
