A U.S. Air Force veteran’s fight for disability benefits is the unusual vehicle for the latest attack on the U.S. Supreme Court’s doctrine that requires courts to defer to government agencies when a statute is ambiguous.
Business groups in particular have been urging the justices—and making some headway—either to overturn or rein in the doctrine that they contend has helped spawn the growth of the administrative state along with more and costly regulations.
